Dion's Pizza offers a digital cookbook collection, "Dion's Ultimate Pizza Collection," comprising over 200 authentic pizza recipes from around the globe, including step-by-step guidance from Chef Dion. By placing an order, you agree to provide accurate, current, and complete information as requested on the order form. All orders are subject to availability and acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, errors in pricing or descriptions, or suspected fraud. In the event of a cancellation, we will issue a refund in accordance with our Refund Policy.

3. Pricing and Payment

The price for each Product is displayed on the Site at the time of purchase. Prices are quoted in the currency specified on the Site and do not include applicable taxes or fees unless otherwise stated. You agree to pay all charges incurred in connection with your order, including any applicable taxes, shipping charges, and fees. Payment must be made using a valid payment method accepted by us. Delivery times may vary depending on the payment processing and email delivery, but we typically send access information within 24 hours of purchase. It is your responsibility to ensure that you provide a valid email address and have the necessary technical capabilities to download and access the digital content. We are not liable for failed delivery due to inaccurate contact information or technical issues beyond our reasonable control.

You agree to indemnify, defend, and hold harmless Dion's Pizza, its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your purchase of Products, your User Content, or your violation of these Terms or any applicable law.

We may terminate or suspend your access to the Site or the Products at any time, without notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Site and Products ceases immediately. All provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property, warranty disclaimers, indemnification, and limitation of liability, shall survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Oklahoma, and you consent to such jurisdiction and venue. If you reside outside of the United States, you consent to the jurisdiction of the courts of Oklahoma.

14. Dispute Resolution

You agree that any claim or dispute arising from your use of the Site or purchase of Products will be resolved through binding arbitration in accordance with the American Arbitration Association's rules. Both parties agree to waive the right to a jury trial and the right to bring a claim as part of a class action. You may opt out of this arbitration provision by notifying us in writing within 30 days of your first use of the Site. If any provision of this dispute resolution clause is found unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Dion's Pizza regarding the use of the Site and purchase of Products, and supersede all prior or contemporaneous communications, agreements, or understandings. You acknowledge that you have not relied on any statements or promises made outside of these Terms.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The failure of Dion's Pizza to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
